Service Agreement


This is our Service Agreement.

1. Definitions

“User” : Every person, clan, group or any unnamed using the TeamSpeak Service.
“Client”, “Clients”, “Customer”, “Customers” : Every person, clan, groups, business or organisation using any services different from the “TeamSpeak”.
“OTUTS” : The OTUTS employees or Staff Members.

2. Interpretation

This Service Agreement must be interpreted in accordance with Belgian law.
In the event that one or more of the provisions of these General Terms and Conditions were found to be in conflict with Belgian law, the remaining provisions will remain in full force.

3. TeamSpeak

– All users have to follow the “TeamSpeak Rules” listed on the “Rules” page. OTUTS has the right to revoke the access or deny the service to anyone ignoring these rules.
– OTUTS provides his TeamSpeak to all users for free, but has the right to discontinue or change the service when we see this as necessary.
– OTUTS can not be held responsible for any damaged caused by a system failure or bug, unless there is an written agreement which states otherwise.
– OTUTS has the right to punish every user, or deny them service whenever they see this necessary.

4. Individuals & Unnamed

– OTUTS remains the right to deny service to a client when they see this as necessary.
– OTUTS is responsible for damage caused by an employee when the damage is related to any work we agreed to execute unless we can show this damage was not related to our delivered services or articles.
The caused damage has to be at least €50 and the client agrees to drop the first €50.
– OTUTS can not be held responsible for damage caused by the clients because of wrong usage of any articles or delivered service.
The wrong usage of any delivered service or article may cause the guarantee to drop.
– OTUTS can not be forced to deliver a faster service when this is not possible.
– OTUTS may drop the guarantee on any article or service when the client did not follow the Agreement of Guarantee.
– OTUTS uses external people to deliver any materials, and so may some articles use another agreement.
– OTUTS only works with “Carry-in” guarantee for individuals.
This means that you must bring the device to us to have any defects covered by the warranty repaired.
In exceptional cases, OTUTS may agree to have a collection or shipment to an OTUTS office carried out at its expense when the item concerned is under an active warranty.
OTUTS will charge these costs if it is established that the damage is not covered by the warranty.

5. Businesses & organisations

– OTUTS has the right to deny service to a client when they see this as necessary.
– OTUTS can not end any written agreement without following the rules, agreed by the client on that agreement.
– Clients can not end any written agreement without following the rules, agreed by the client, on that agreement.
– OTUTS may drop the guarantee on any article or service when the client didn’t not follow the Agreement of Guarantee.
– OTUTS uses external people to deliver any materials, and so may some articles use another agreement.
– OTUTS is responsible for damage caused by an employee when the damage is related to any work we agreed to execute whenever this can be shown.
The caused damage has to be at least €200 and the client agrees to drop the first €200.
– OTUTS can not be held responsible for damage caused by the clients because of wrong usage of any articles or delivered service.
The wrong usage of any delivered service or article may cause the guarantee to drop and we can not be held responsible for any damage anymore.
– OTUTS works for companies & organizations with the standard Carry-In warranty, unless otherwise agreed with a written agreement between OTUTS and the relevant company or organization.

6. Shipments

Shipment processing time:

All orders are processed within 2-3 business days when the articles are in stock.
Orders are not shipped or delivered on weekends or holidays.
If we are experiencing a high volume of orders, shipments may be delayed by a few days.
Please allow additional days in transit for delivery. If there will be a significant delay in shipment of your order, we will contact you via email or telephone.

Shipping rates:

Shipping charges for your order will be calculated and displayed on your quotation.

Shipment confirmation & Order tracking:

You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s).
The tracking number will be active within 24 hours.

Customs, Duties and Taxes:

OTUTS is not responsible for any customs and taxes applied to your order.
All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

Damages:

OTUTS is not liable for any products damaged or lost during shipping.
If you received your order damaged or with missing goods, you need to file a claim by sending a mail to contact@otuts.eu within 36 hours after receiving the shipment.
Please save all packaging materials and damaged goods before filing a claim.

Returns:

Returns are possible withing 14 days after receiving the item, unless stated otherwise.
Returns are on cost and responsibility of the client.
OTUTS will check the contents before accepting the return.
If goods are missing or damaged, OTUTS will refuse to void the bill.

OTUTS can charge an administrative fee of €15 for the return if they consider this necessary.

7. Disclaimer

– You automatically agree to this Service Agreement by using any of our Services.
– OTUTS can change or update this agreement at any time without warning you.

– Only the Dutch-speaking courts of the district of Brussels or the peace court of Vilvoorde are competent to know any dispute concerning this Service Agreement.
